Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Always Leads website and Services (collectively, the “Services”) operated by Always Leads (“we,” “us,” or “the Company”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Services. You agree to provide accurate, current, and complete account information and to keep it updated. You are responsible for all activity under your account and must keep your credentials secure.

2. Description of the Services

Always Leads provides website design, CRM, marketing funnels, automations, missed-call text-back, review funnels, local SEO, and SMS/MMS messaging for service businesses and contractors. Specific features and pricing are described on our website and may change at our discretion.

3. SMS & MMS Messaging Terms (A2P 10DLC)

Our SMS features are delivered over U.S. carrier networks and are subject to the A2P 10DLC registration and compliance framework. By using our SMS features you agree to the following:

• Consent: You represent that you have obtained express prior consent from every recipient before sending them SMS/MMS messages through our Services, and that you will maintain records of that consent.
• Permitted Use: Messages must be informational or transactional, or promotional only where the recipient has opted in. You must not send messages that are illegal, deceptive, or that violate carrier, CTIA, or FCC rules.
• Opt-Out: You must honor all opt-out requests promptly. Recipients may reply STOP to unsubscribe and HELP for assistance. We may automatically suppress opted-out numbers from future campaigns.
• Message & Data Rates: Message and data rates may apply to recipients according to their mobile plan. We are not responsible for carrier charges.
• Carrier Compliance: You are responsible for the accuracy of the business and campaign information you provide for A2P 10DLC registration. We may refuse, suspend, or terminate messaging for any campaign or number that fails carrier vetting or violates these Terms.
• No Guarantee of Delivery: Carriers may delay, filter, block, or fail to deliver messages for reasons outside our control, and we are not liable for such outcomes.

4. Acceptable Use

You agree not to:

• Use the Services for any unlawful, fraudulent, or abusive purpose;
• Send unsolicited commercial messages, spam, or messages without the required consent;
• Upload viruses, malware, or code designed to disrupt the Services;
• Attempt to access systems or data you are not authorized to access;
• Resell, sublicense, or reverse engineer the Services without permission;
• Use the Services in a way that could damage our reputation or carrier standing.

5. Fees, Billing & Refunds

Fees for the Services are described on our pricing page. By subscribing, you authorize us to charge the recurring fee (for example, $97/month) to your designated payment method until you cancel. There are no contracts; you may cancel at any time from your dashboard. Fees are non-refundable except where required by law. We may change fees with reasonable advance notice.

6. Your Content & Data

You retain ownership of content and data you upload, including lead lists and message content. You grant us a license to use it solely to operate the Services. You are responsible for ensuring you have the rights and consents (including SMS opt-in consent) to use any data you submit.

7. Intellectual Property

The Services, including text, graphics, logos, and software, are the intellectual property of Always Leads or its licensors and are protected by applicable laws. Nothing in these Terms grants you any right to use our trademarks or branding without prior written consent.

8. Third-Party Services

The Services integrate with third-party platforms (such as phone carriers, payment processors, and analytics tools) whose terms and policies also apply. We are not responsible for the practices or availability of those third parties.

9. Disclaimer of Warranties

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or that messages will always be delivered.

10. Limitation of Liability

To the fullest extent permitted by law, Always Leads and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services, including the non-delivery or filtering of SMS messages. Our aggregate liability is limited to the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Always Leads from any claims, damages, or expenses (including legal fees) arising from your use of the Services, your content, or your breach of these Terms, including any SMS sent without proper consent.

12. Termination

You may cancel your account at any time. We may suspend or terminate your access to the Services, including SMS messaging, if you violate these Terms, fail carrier compliance, or we determine that continued service creates legal or reputational risk.

13. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of laws provisions. You submit to the exclusive jurisdiction of the courts located in Nevada for any dispute arising from these Terms.

14. Changes to These Terms

We may revise these Terms from time to time. We will post the updated version on this page with a revised “Last updated” date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
